Professional and student members of KANAAE are covered by a $2 million liability insurance policy. This provides $2 million dollars of protection per occurrence per member. Defense costs are paid [ Student studying ]in addition to this amount. Each member receives their own certificate of insurance to evidence their coverage. The coverage is provided through the Trust for Insuring Educators (TIE) and is administered by Forrest T. Jones & Company, Inc.


FAQ'S ABOUT OUR LIABILITY INSURANCE POLICY *

Q. Who is eligible for coverage?

A. Any professional or student member of KANAAE who is an employee of any public or private educational entity (i.e., school, college or university) can obtain coverage. This must be your main occupation. Owners and board members are not eligible for coverage. Only registered nurses, school psychologists and physical therapists are eligible for coverage of medically related teaching or services.

A. Your coverage provides $2,000,000 of protection per person per occurrence. Defense costs are paid in addition to this amount. This is an occurrence form policy and that means that you are protected against liability arising from a covered event that occurs during the policy year, no matter when the claim is made.


Q. What is covered under this policy?

A. With this professional liability plan you will be protected against a broad range of exposures, including the following allegations (whether those allegations are true or false):

· Injuries to students under your supervision
· Improper placement of students
· Improper methods employed in instruction, counseling, research design, and so forth
· Hiring unqualified persons
· Failure to educate
· Failure to promote students or grant credit
· Violation of student civil rights
· Negative consequences in the implementation of the recommendations of research studies

Q. What matters are not covered by this policy?

A. This plan does not respond to criminal actions (except as noted below), corporal punishment where prohibited by law, or to acts or omissions with respect to work carried on as a part-time consultant unless you have applied for coverage as such and paid the appropriate premium. (See below for more information on additional part-time coverage.) However, this plan will not cover psychological services rendered by you as a part-time private consultant or if you have a full or part-time private psychological practice.

Q. Am I covered for lawsuits based on sexual harassment or abuse?

A. Yes! The policy will reimburse your attorney's fees provided you are found not guilty and the charges are dismissed. The plan pays 90% of the attorney fees, after a $100 deductible, up to $50,000 (annual maximum)

Q. What if I face criminal charges arising out of corporal punishment?

A. The policy will reimburse your attorney's fees provided you are found not guilty and the charges are dismissed. The plan pays 90% of the attorney fees, after a $100 deductible, up to $10,000 (annual maximum).

Q. What if I am sued and the relief requested is not monetary damages (non-pecuniary relief)?

A. If you are sued for non-pecuniary relief, you are provided with up to $35,000 for defense costs.

Q. Am I covered for my responsibilities for supervising other employees?

Q. Am I covered by this policy if I am an independent contractor or an educator in private practice?

A. You are not qualified for this plan, but there may be other coverage available through our insurer. Please contact the KANAEE office.

A. If your primary employment is with an educational organization, you can obtain coverage to cover part-time educational jobs (consultant, tutor, teacher) by paying a modest additional amount. The part-time work must be of a nature similar to your regular responsibilities. To be eligible for the additional part-time coverage you must meet two requirements.

1. This must be your part-time or secondary job and it must be educationally and not medically related, and must fall within the same underwriting guidelines as your main occupation.

2. You must receive payment for the job.

Q. When is my plan effective?

A. Your coverage becomes effective on the date you become a member of KANAAE.

Q. KANAAE is new and relatively small. Is my coverage dependable?

A. Absolutely! KANAAE's liability policy is as solid as any being offered. The strength of your insurer is not based on the age or size of KANAAE. It is based on the experience and stability of your insurance provider. We are covered by the best! Read below for more information about our insurer.

LEGAL REPRESENTATION

[ Books ]Our liability policy also provides for legal representation in the following circumstances:

If you are threatened with termination, suspension, reassignment or demotion, the plan will pay up to $250 for your initial consultation with an attorney, and it will pay up to $750 of the cost of having an attorney represent you at a formal hearing of a school board or other authority. You will also receive up to $750 for legal fees, subject to a $100 deductible, if you decide to sue because of termination, reassignment, suspension or demotion.

If you supervise other employees and are sued by one of them regarding covered personnel matters, the policy will pay 90% of your defense costs for a maximum of $5,000, subject to a $100 deductible.

ABOUT OUR LIABILITY INSURANCE PROVIDER

The Forrest T. Jones Companies have over 30 years experience handling association insurance needs and are the administrators of the Trust for Insuring Educators (TIE).
